中共中央国务院关于推进安全生产领域改革发展的意见

   安(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)是关系(xi)人(ren)民(min)群众(zhong)生(sheng)(sheng)(sheng)(sheng)(sheng)命(ming)财产(chan)安(an)(an)全(quan)(quan)的大事(shi),是经(jing)济社会协调健康(kang)发展的标志,是党和(he)政府对人(ren)民(min)利益(yi)高度负责(ze)(ze)的要(yao)(yao)求。党中央、国(guo)务院历来(lai)高度重视安(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)工(gong)作(zuo)(zuo),党的十八大以来(lai)作(zuo)(zuo)出(chu)一(yi)系(xi)列重大决(jue)策(ce)部署,推(tui)(tui)动全(quan)(quan)国(guo)安(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)工(gong)作(zuo)(zuo)取得(de)积(ji)极进展。同时也要(yao)(yao)看到(dao),当(dang)前我国(guo)正处在(zai)工(gong)业(ye)化(hua)、城镇化(hua)持续(xu)推(tui)(tui)进过程中,生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)经(jing)营规模不断(duan)扩大,传(chuan)统和(he)新型生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)经(jing)营方式并存,各类(lei)事(shi)故(gu)(gu)隐患(huan)和(he)安(an)(an)全(quan)(quan)风险交(jiao)织(zhi)叠加,安(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)基础薄弱、监管体制(zhi)(zhi)机(ji)制(zhi)(zhi)和(he)法律制(zhi)(zhi)度不完善、企(qi)业(ye)主体责(ze)(ze)任落(luo)实不力等问(wen)题(ti)依然突出(chu),生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)安(an)(an)全(quan)(quan)事(shi)故(gu)(gu)易发多发,尤(you)其是重特大安(an)(an)全(quan)(quan)事(shi)故(gu)(gu)频发势头尚(shang)未(wei)得(de)到(dao)有(you)效(xiao)遏制(zhi)(zhi),一(yi)些事(shi)故(gu)(gu)发生(sheng)(sheng)(sheng)(sheng)(sheng)呈现由高危行(xing)业(ye)领(ling)(ling)域向其他行(xing)业(ye)领(ling)(ling)域蔓延趋势,直接危及(ji)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)安(an)(an)全(quan)(quan)和(he)公共(gong)安(an)(an)全(quan)(quan)。为(wei)进一(yi)步加强安(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)工(gong)作(zuo)(zuo),现就(jiu)推(tui)(tui)进安(an)(an)全(quan)(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)领(ling)(ling)域改革发展提出(chu)如下意见。

  一、总体(ti)要求

  (一)指导(dao)思(si)想。全(quan)面贯彻党的(de)(de)(de)(de)十(shi)八大(da)和(he)十(shi)八届三(san)中、四中、五中、六中全(quan)会(hui)(hui)精神,以邓小平理(li)论(lun)、“三(san)个(ge)代表”重(zhong)要思(si)想、科学发(fa)(fa)展(zhan)(zhan)观为指导(dao),深入贯彻习近平总书记系列重(zhong)要讲话精神和(he)治国理(li)政新(xin)理(li)念新(xin)思(si)想新(xin)战(zhan)略,进一步增强“四个(ge)意识”,紧(jin)紧(jin)围绕统筹(chou)推进“五位一体(ti)”总体(ti)布(bu)局(ju)和(he)协(xie)调推进“四个(ge)全(quan)面”战(zhan)略布(bu)局(ju),牢固树立新(xin)发(fa)(fa)展(zhan)(zhan)理(li)念,坚持(chi)安(an)(an)全(quan)发(fa)(fa)展(zhan)(zhan),坚守发(fa)(fa)展(zhan)(zhan)决不能以牺牲安(an)(an)全(quan)为代价这条不可逾越(yue)的(de)(de)(de)(de)红线,以防范遏(e)制重(zhong)特大(da)生(sheng)产安(an)(an)全(quan)事故为重(zhong)点,坚持(chi)安(an)(an)全(quan)第一、预防为主、综合治理(li)的(de)(de)(de)(de)方(fang)针,加强领(ling)导(dao)、改革(ge)(ge)创新(xin),协(xie)调联动、齐抓共管,着(zhe)力(li)强化企业安(an)(an)全(quan)生(sheng)产主体(ti)责任,着(zhe)力(li)堵塞监督管理(li)漏洞(dong),着(zhe)力(li)解决不遵守法律法规的(de)(de)(de)(de)问题,依(yi)靠(kao)严(yan)密的(de)(de)(de)(de)责任体(ti)系、严(yan)格的(de)(de)(de)(de)法治措施、有(you)效的(de)(de)(de)(de)体(ti)制机制、有(you)力(li)的(de)(de)(de)(de)基础保(bao)障和(he)完(wan)善的(de)(de)(de)(de)系统治理(li),切实增强安(an)(an)全(quan)防范治理(li)能力(li),大(da)力(li)提升我国安(an)(an)全(quan)生(sheng)产整体(ti)水平,确保(bao)人民群(qun)众安(an)(an)康(kang)幸福(fu)、共享(xiang)改革(ge)(ge)发(fa)(fa)展(zhan)(zhan)和(he)社会(hui)(hui)文明进步成(cheng)果。

  (二)基本原则

  ——坚持安(an)全(quan)发展(zhan)。贯彻以人(ren)(ren)民为(wei)中心(xin)的(de)(de)发展(zhan)思想,始终把人(ren)(ren)的(de)(de)生命安(an)全(quan)放(fang)在首(shou)位,正(zheng)确处理安(an)全(quan)与(yu)发展(zhan)的(de)(de)关系,大力实施安(an)全(quan)发展(zhan)战略,为(wei)经济社会发展(zhan)提(ti)供强有力的(de)(de)安(an)全(quan)保障。

  ——坚(jian)持改革创(chuang)新(xin)。不(bu)断(duan)推(tui)进安(an)(an)(an)全生产(chan)(chan)理论创(chuang)新(xin)、制度(du)创(chuang)新(xin)、体制机(ji)制创(chuang)新(xin)、科技创(chuang)新(xin)和(he)文化创(chuang)新(xin),增强企(qi)业内生动(dong)力,激发全社(she)会(hui)创(chuang)新(xin)活力,破解安(an)(an)(an)全生产(chan)(chan)难题(ti),推(tui)动(dong)安(an)(an)(an)全生产(chan)(chan)与经济社(she)会(hui)协调发展。

  ——坚持依法(fa)(fa)监(jian)管。大(da)力(li)弘扬社(she)会主义法(fa)(fa)治(zhi)精神,运用(yong)法(fa)(fa)治(zhi)思维(wei)和(he)法(fa)(fa)治(zhi)方式,深化安全(quan)生(sheng)产(chan)监(jian)管执(zhi)(zhi)法(fa)(fa)体(ti)(ti)制(zhi)改革,完善安全(quan)生(sheng)产(chan)法(fa)(fa)律法(fa)(fa)规(gui)和(he)标(biao)准体(ti)(ti)系(xi),严格规(gui)范(fan)公正文(wen)明执(zhi)(zhi)法(fa)(fa),增强监(jian)管执(zhi)(zhi)法(fa)(fa)效能(neng),提高安全(quan)生(sheng)产(chan)法(fa)(fa)治(zhi)化水(shui)平。

  ——坚持源头防(fang)范。严(yan)格安全(quan)生(sheng)(sheng)(sheng)产(chan)市(shi)场准入,经济(ji)社会(hui)发(fa)展要以安全(quan)为(wei)前(qian)提,把安全(quan)生(sheng)(sheng)(sheng)产(chan)贯穿城乡(xiang)规(gui)划布局、设(she)计、建(jian)设(she)、管理(li)(li)和(he)企业生(sheng)(sheng)(sheng)产(chan)经营活动全(quan)过程(cheng)。构建(jian)风险分级管控和(he)隐患排(pai)查治理(li)(li)双重预(yu)防(fang)工作(zuo)机制,严(yan)防(fang)风险演(yan)变、隐患升级导(dao)致(zhi)生(sheng)(sheng)(sheng)产(chan)安全(quan)事故(gu)发(fa)生(sheng)(sheng)(sheng)。

  ——坚(jian)持(chi)系(xi)统治(zhi)理(li)。严(yan)密层级治(zhi)理(li)和行业治(zhi)理(li)、政府治(zhi)理(li)、社会治(zhi)理(li)相(xiang)结合的安(an)全生产治(zhi)理(li)体系(xi),组织动员各方面(mian)力量实施社会共治(zhi)。综合运用法(fa)律、行政、经济、市场等手(shou)段,落实人防(fang)、技防(fang)、物防(fang)措施,提升全社会安(an)全生产治(zhi)理(li)能力。

  (三)目(mu)(mu)标任务。到(dao)2020年,安(an)全生产(chan)(chan)(chan)(chan)监管体(ti)制机(ji)制基(ji)本(ben)成熟,法(fa)律制度基(ji)本(ben)完(wan)善,全国生产(chan)(chan)(chan)(chan)安(an)全事(shi)故(gu)总(zong)量明显(xian)减(jian)少,职(zhi)业病(bing)危害防治(zhi)取得积(ji)极(ji)进(jin)展,重特大(da)生产(chan)(chan)(chan)(chan)安(an)全事(shi)故(gu)频发势(shi)头得到(dao)有效遏制,安(an)全生产(chan)(chan)(chan)(chan)整体(ti)水平与全面(mian)建成小康社会目(mu)(mu)标相适应。到(dao)2030年,实(shi)现安(an)全生产(chan)(chan)(chan)(chan)治(zhi)理体(ti)系和治(zhi)理能力现代化,全民安(an)全文明素质全面(mian)提升,安(an)全生产(chan)(chan)(chan)(chan)保障能力显(xian)著增(zeng)强(qiang),为实(shi)现中华民族伟大(da)复兴的中国梦奠定稳(wen)固可靠的安(an)全生产(chan)(chan)(chan)(chan)基(ji)础。

  二(er)、健全(quan)落实安全(quan)生(sheng)产责任制

  (四)明(ming)确地方党委(wei)和政(zheng)府领导(dao)责(ze)任(ren)。坚持(chi)党政(zheng)同责(ze)、一岗双责(ze)、齐抓共管、失职追责(ze),完(wan)善安(an)全生(sheng)产(chan)(chan)责(ze)任(ren)体(ti)系。地方各(ge)级(ji)(ji)党委(wei)和政(zheng)府要始终把安(an)全生(sheng)产(chan)(chan)摆(bai)在重要位(wei)置,加强组织领导(dao)。党政(zheng)主要负(fu)责(ze)人(ren)是本地区(qu)安(an)全生(sheng)产(chan)(chan)第一责(ze)任(ren)人(ren),班子(zi)其(qi)他成员(yuan)(yuan)(yuan)对(dui)分(fen)管范围内(nei)的安(an)全生(sheng)产(chan)(chan)工作负(fu)领导(dao)责(ze)任(ren)。地方各(ge)级(ji)(ji)安(an)全生(sheng)产(chan)(chan)委(wei)员(yuan)(yuan)(yuan)会主任(ren)由(you)政(zheng)府主要负(fu)责(ze)人(ren)担(dan)任(ren),成员(yuan)(yuan)(yuan)由(you)同级(ji)(ji)党委(wei)和政(zheng)府及相关(guan)部门(men)负(fu)责(ze)人(ren)组成。

  地方各级党委要认真贯彻执行党的(de)安全(quan)(quan)生(sheng)(sheng)产(chan)方针,在统(tong)揽本地区(qu)经济社(she)会发(fa)展全(quan)(quan)局中同步推进安全(quan)(quan)生(sheng)(sheng)产(chan)工(gong)(gong)作,定期研究决定安全(quan)(quan)生(sheng)(sheng)产(chan)重大问题。加强安全(quan)(quan)生(sheng)(sheng)产(chan)监(jian)管机构领(ling)导班(ban)子、干部队(dui)伍建(jian)设。严格安全(quan)(quan)生(sheng)(sheng)产(chan)履职绩效(xiao)考核(he)和失(shi)职责(ze)任追究。强化(hua)安全(quan)(quan)生(sheng)(sheng)产(chan)宣(xuan)传(chuan)教育和舆论(lun)引导。发(fa)挥人大对安全(quan)(quan)生(sheng)(sheng)产(chan)工(gong)(gong)作的(de)监(jian)督(du)促进作用(yong)、政协对安全(quan)(quan)生(sheng)(sheng)产(chan)工(gong)(gong)作的(de)民主(zhu)监(jian)督(du)作用(yong)。推动(dong)组织(zhi)、宣(xuan)传(chuan)、政法、机构编制等(deng)单位(wei)支持保(bao)障安全(quan)(quan)生(sheng)(sheng)产(chan)工(gong)(gong)作。动(dong)员社(she)会各界积极参与(yu)、支持、监(jian)督(du)安全(quan)(quan)生(sheng)(sheng)产(chan)工(gong)(gong)作。

  地(di)方各级(ji)政(zheng)府要把安(an)(an)(an)(an)(an)全生(sheng)产(chan)纳入经济社会(hui)(hui)发展总体(ti)规划,制定实施安(an)(an)(an)(an)(an)全生(sheng)产(chan)专项规划,健全安(an)(an)(an)(an)(an)全投入保(bao)障制度。及时研究部(bu)署(shu)安(an)(an)(an)(an)(an)全生(sheng)产(chan)工作,严格(ge)落实属地(di)监管(guan)责(ze)(ze)任。充分发挥安(an)(an)(an)(an)(an)全生(sheng)产(chan)委员会(hui)(hui)作用(yong),实施安(an)(an)(an)(an)(an)全生(sheng)产(chan)责(ze)(ze)任目标管(guan)理。建(jian)立安(an)(an)(an)(an)(an)全生(sheng)产(chan)巡(xun)查(cha)制度,督促各部(bu)门和下级(ji)政(zheng)府履职(zhi)尽责(ze)(ze)。加强(qiang)安(an)(an)(an)(an)(an)全生(sheng)产(chan)监管(guan)执法能力建(jian)设,推进安(an)(an)(an)(an)(an)全科技创新,提升(sheng)信(xin)息化(hua)管(guan)理水(shui)平。严格(ge)安(an)(an)(an)(an)(an)全准入标准,指(zhi)导管(guan)控安(an)(an)(an)(an)(an)全风险,督促整治重大隐患,强(qiang)化(hua)源头(tou)治理。加强(qiang)应急管(guan)理,完(wan)善安(an)(an)(an)(an)(an)全生(sheng)产(chan)应急救援体(ti)系。依(yi)法依(yi)规开展事故调查(cha)处理,督促落实问题整改。

  (五)明确(que)部(bu)(bu)门(men)(men)监管(guan)(guan)(guan)(guan)责(ze)任。按照管(guan)(guan)(guan)(guan)行(xing)(xing)(xing)业(ye)(ye)(ye)必须管(guan)(guan)(guan)(guan)安(an)(an)(an)全(quan)、管(guan)(guan)(guan)(guan)业(ye)(ye)(ye)务必须管(guan)(guan)(guan)(guan)安(an)(an)(an)全(quan)、管(guan)(guan)(guan)(guan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)经营必须管(guan)(guan)(guan)(guan)安(an)(an)(an)全(quan)和(he)(he)谁主管(guan)(guan)(guan)(guan)谁负责(ze)的(de)原(yuan)则,厘清安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)综合(he)监管(guan)(guan)(guan)(guan)与(yu)行(xing)(xing)(xing)业(ye)(ye)(ye)监管(guan)(guan)(guan)(guan)的(de)关(guan)系,明确(que)各有(you)(you)关(guan)部(bu)(bu)门(men)(men)安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)和(he)(he)职业(ye)(ye)(ye)健(jian)康工(gong)(gong)(gong)(gong)作(zuo)职责(ze),并落实到部(bu)(bu)门(men)(men)工(gong)(gong)(gong)(gong)作(zuo)职责(ze)规(gui)(gui)(gui)(gui)定(ding)中。安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)监督管(guan)(guan)(guan)(guan)理(li)(li)部(bu)(bu)门(men)(men)负责(ze)安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)法(fa)(fa)规(gui)(gui)(gui)(gui)标准(zhun)和(he)(he)政(zheng)策规(gui)(gui)(gui)(gui)划制定(ding)修(xiu)订、执(zhi)法(fa)(fa)监督、事故调(diao)查处理(li)(li)、应(ying)急救援管(guan)(guan)(guan)(guan)理(li)(li)、统计分析、宣传(chuan)教育(yu)培训等(deng)综合(he)性工(gong)(gong)(gong)(gong)作(zuo),承担(dan)职责(ze)范(fan)围内行(xing)(xing)(xing)业(ye)(ye)(ye)领(ling)(ling)域(yu)安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)和(he)(he)职业(ye)(ye)(ye)健(jian)康监管(guan)(guan)(guan)(guan)执(zhi)法(fa)(fa)职责(ze)。负有(you)(you)安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)监督管(guan)(guan)(guan)(guan)理(li)(li)职责(ze)的(de)有(you)(you)关(guan)部(bu)(bu)门(men)(men)依法(fa)(fa)依规(gui)(gui)(gui)(gui)履行(xing)(xing)(xing)相关(guan)行(xing)(xing)(xing)业(ye)(ye)(ye)领(ling)(ling)域(yu)安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)和(he)(he)职业(ye)(ye)(ye)健(jian)康监管(guan)(guan)(guan)(guan)职责(ze),强(qiang)化监管(guan)(guan)(guan)(guan)执(zhi)法(fa)(fa),严厉查处违法(fa)(fa)违规(gui)(gui)(gui)(gui)行(xing)(xing)(xing)为。其(qi)他(ta)行(xing)(xing)(xing)业(ye)(ye)(ye)领(ling)(ling)域(yu)主管(guan)(guan)(guan)(guan)部(bu)(bu)门(men)(men)负有(you)(you)安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)管(guan)(guan)(guan)(guan)理(li)(li)责(ze)任,要将安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)工(gong)(gong)(gong)(gong)作(zuo)作(zuo)为行(xing)(xing)(xing)业(ye)(ye)(ye)领(ling)(ling)域(yu)管(guan)(guan)(guan)(guan)理(li)(li)的(de)重(zhong)要内容,从行(xing)(xing)(xing)业(ye)(ye)(ye)规(gui)(gui)(gui)(gui)划、产(chan)业(ye)(ye)(ye)政(zheng)策、法(fa)(fa)规(gui)(gui)(gui)(gui)标准(zhun)、行(xing)(xing)(xing)政(zheng)许可等(deng)方面加强(qiang)行(xing)(xing)(xing)业(ye)(ye)(ye)安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)工(gong)(gong)(gong)(gong)作(zuo),指导督促企事业(ye)(ye)(ye)单位(wei)加强(qiang)安(an)(an)(an)全(quan)管(guan)(guan)(guan)(guan)理(li)(li)。党(dang)委和(he)(he)政(zheng)府其(qi)他(ta)有(you)(you)关(guan)部(bu)(bu)门(men)(men)要在职责(ze)范(fan)围内为安(an)(an)(an)全(quan)生(sheng)(sheng)(sheng)(sheng)(sheng)产(chan)工(gong)(gong)(gong)(gong)作(zuo)提供支持(chi)保障,共(gong)同推进安(an)(an)(an)全(quan)发展。

  (六)严格(ge)落(luo)(luo)实(shi)企业(ye)(ye)(ye)(ye)主体(ti)责(ze)(ze)(ze)(ze)(ze)任(ren)(ren)。企业(ye)(ye)(ye)(ye)对本单位(wei)安全(quan)(quan)生产(chan)(chan)和(he)职业(ye)(ye)(ye)(ye)健康(kang)工(gong)作负全(quan)(quan)面责(ze)(ze)(ze)(ze)(ze)任(ren)(ren),要严格(ge)履行(xing)安全(quan)(quan)生产(chan)(chan)法(fa)定(ding)责(ze)(ze)(ze)(ze)(ze)任(ren)(ren),建(jian)立(li)健全(quan)(quan)自我约(yue)束(shu)、持续改(gai)进的内生机制(zhi)(zhi)。企业(ye)(ye)(ye)(ye)实(shi)行(xing)全(quan)(quan)员安全(quan)(quan)生产(chan)(chan)责(ze)(ze)(ze)(ze)(ze)任(ren)(ren)制(zhi)(zhi)度(du),法(fa)定(ding)代表人(ren)和(he)实(shi)际(ji)控制(zhi)(zhi)人(ren)同为(wei)安全(quan)(quan)生产(chan)(chan)第一(yi)责(ze)(ze)(ze)(ze)(ze)任(ren)(ren)人(ren),主要技术负责(ze)(ze)(ze)(ze)(ze)人(ren)负有(you)安全(quan)(quan)生产(chan)(chan)技术决策和(he)指挥权,强化部门安全(quan)(quan)生产(chan)(chan)职责(ze)(ze)(ze)(ze)(ze),落(luo)(luo)实(shi)一(yi)岗双责(ze)(ze)(ze)(ze)(ze)。完善落(luo)(luo)实(shi)混(hun)合所有(you)制(zhi)(zhi)企业(ye)(ye)(ye)(ye)以及(ji)跨地(di)区、多层级(ji)和(he)境外中资企业(ye)(ye)(ye)(ye)投资主体(ti)的安全(quan)(quan)生产(chan)(chan)责(ze)(ze)(ze)(ze)(ze)任(ren)(ren)。建(jian)立(li)企业(ye)(ye)(ye)(ye)全(quan)(quan)过程安全(quan)(quan)生产(chan)(chan)和(he)职业(ye)(ye)(ye)(ye)健康(kang)管(guan)(guan)理(li)制(zhi)(zhi)度(du),做到安全(quan)(quan)责(ze)(ze)(ze)(ze)(ze)任(ren)(ren)、管(guan)(guan)理(li)、投入、培训和(he)应急救援“五(wu)到位(wei)”。国有(you)企业(ye)(ye)(ye)(ye)要发挥安全(quan)(quan)生产(chan)(chan)工(gong)作示范带(dai)头作用,自觉接受属地(di)监管(guan)(guan)。

  (七)健全(quan)(quan)(quan)责任考(kao)(kao)核(he)(he)(he)机制。建(jian)立(li)与(yu)全(quan)(quan)(quan)面建(jian)成小康(kang)社会相适应和(he)(he)体(ti)现安(an)全(quan)(quan)(quan)发(fa)展水(shui)平的(de)(de)考(kao)(kao)核(he)(he)(he)评(ping)价体(ti)系。完(wan)善(shan)考(kao)(kao)核(he)(he)(he)制度(du),统(tong)筹整合、科学设(she)定安(an)全(quan)(quan)(quan)生产(chan)(chan)(chan)考(kao)(kao)核(he)(he)(he)指标,加大安(an)全(quan)(quan)(quan)生产(chan)(chan)(chan)在社会治安(an)综合治理(li)、精神文明建(jian)设(she)等考(kao)(kao)核(he)(he)(he)中的(de)(de)权重(zhong)。各(ge)(ge)(ge)级政府(fu)要对同级安(an)全(quan)(quan)(quan)生产(chan)(chan)(chan)委员会成员单位和(he)(he)下级政府(fu)实(shi)(shi)(shi)施严格的(de)(de)安(an)全(quan)(quan)(quan)生产(chan)(chan)(chan)工作责任考(kao)(kao)核(he)(he)(he),实(shi)(shi)(shi)行过程考(kao)(kao)核(he)(he)(he)与(yu)结果考(kao)(kao)核(he)(he)(he)相结合。各(ge)(ge)(ge)地区(qu)各(ge)(ge)(ge)单位要建(jian)立(li)安(an)全(quan)(quan)(quan)生产(chan)(chan)(chan)绩效与(yu)履职评(ping)定、职务晋升(sheng)、奖励惩处挂钩制度(du),严格落实(shi)(shi)(shi)安(an)全(quan)(quan)(quan)生产(chan)(chan)(chan)“一票(piao)否决”制度(du)。

  (八)严(yan)格责(ze)(ze)(ze)(ze)(ze)任追(zhui)究制(zhi)度。实(shi)行(xing)(xing)党(dang)政领(ling)导干部任期安全生(sheng)产(chan)(chan)(chan)责(ze)(ze)(ze)(ze)(ze)任制(zhi),日常工作依(yi)责(ze)(ze)(ze)(ze)(ze)尽职(zhi)、发生(sheng)事(shi)(shi)故(gu)依(yi)责(ze)(ze)(ze)(ze)(ze)追(zhui)究。依(yi)法(fa)(fa)依(yi)规制(zhi)定(ding)各(ge)有(you)关(guan)部门安全生(sheng)产(chan)(chan)(chan)权力和责(ze)(ze)(ze)(ze)(ze)任清单,尽职(zhi)照单免责(ze)(ze)(ze)(ze)(ze)、失职(zhi)照单问责(ze)(ze)(ze)(ze)(ze)。建立企业(ye)生(sheng)产(chan)(chan)(chan)经营全过程(cheng)安全责(ze)(ze)(ze)(ze)(ze)任追(zhui)溯制(zhi)度。严(yan)肃查(cha)处安全生(sheng)产(chan)(chan)(chan)领(ling)域项目(mu)审批、行(xing)(xing)政许可、监管执法(fa)(fa)中的(de)(de)失职(zhi)渎职(zhi)和权钱交易等腐败行(xing)(xing)为。严(yan)格事(shi)(shi)故(gu)直报制(zhi)度,对瞒报、谎报、漏报、迟报事(shi)(shi)故(gu)的(de)(de)单位和个人依(yi)法(fa)(fa)依(yi)规追(zhui)责(ze)(ze)(ze)(ze)(ze)。对被追(zhui)究刑(xing)事(shi)(shi)责(ze)(ze)(ze)(ze)(ze)任的(de)(de)生(sheng)产(chan)(chan)(chan)经营者依(yi)法(fa)(fa)实(shi)施(shi)相(xiang)(xiang)应的(de)(de)职(zhi)业(ye)禁入,对事(shi)(shi)故(gu)发生(sheng)负有(you)重大(da)责(ze)(ze)(ze)(ze)(ze)任的(de)(de)社(she)会服务机构和人员依(yi)法(fa)(fa)严(yan)肃追(zhui)究法(fa)(fa)律(lv)责(ze)(ze)(ze)(ze)(ze)任,并(bing)依(yi)法(fa)(fa)实(shi)施(shi)相(xiang)(xiang)应的(de)(de)行(xing)(xing)业(ye)禁入。

  三、改(gai)革安全监管监察体(ti)(ti)制(zhi)

  (九)完(wan)善(shan)监(jian)督(du)(du)管(guan)(guan)(guan)(guan)(guan)理体制(zhi)(zhi)。加强各级安(an)(an)全(quan)(quan)生(sheng)产(chan)委员会组(zu)织(zhi)领导,充分发挥其统筹协(xie)调作用,切(qie)实解决(jue)突出矛盾和(he)问题。各级安(an)(an)全(quan)(quan)生(sheng)产(chan)监(jian)督(du)(du)管(guan)(guan)(guan)(guan)(guan)理部门(men)(men)承担本级安(an)(an)全(quan)(quan)生(sheng)产(chan)委员会日(ri)常工(gong)作,负(fu)(fu)责(ze)指导协(xie)调、监(jian)督(du)(du)检查、巡查考(kao)核(he)本级政府(fu)有关部门(men)(men)和(he)下级政府(fu)安(an)(an)全(quan)(quan)生(sheng)产(chan)工(gong)作,履(lv)行(xing)综合(he)监(jian)管(guan)(guan)(guan)(guan)(guan)职(zhi)(zhi)(zhi)(zhi)责(ze)。负(fu)(fu)有安(an)(an)全(quan)(quan)生(sheng)产(chan)监(jian)督(du)(du)管(guan)(guan)(guan)(guan)(guan)理职(zhi)(zhi)(zhi)(zhi)责(ze)的部门(men)(men),依照有关法(fa)律法(fa)规和(he)部门(men)(men)职(zhi)(zhi)(zhi)(zhi)责(ze),健(jian)全(quan)(quan)安(an)(an)全(quan)(quan)生(sheng)产(chan)监(jian)管(guan)(guan)(guan)(guan)(guan)体制(zhi)(zhi),严(yan)格(ge)落实监(jian)管(guan)(guan)(guan)(guan)(guan)职(zhi)(zhi)(zhi)(zhi)责(ze)。相关部门(men)(men)按照各自职(zhi)(zhi)(zhi)(zhi)责(ze)建(jian)立(li)(li)完(wan)善(shan)安(an)(an)全(quan)(quan)生(sheng)产(chan)工(gong)作机制(zhi)(zhi),形成齐抓共管(guan)(guan)(guan)(guan)(guan)格(ge)局。坚持管(guan)(guan)(guan)(guan)(guan)安(an)(an)全(quan)(quan)生(sheng)产(chan)必(bi)须管(guan)(guan)(guan)(guan)(guan)职(zhi)(zhi)(zhi)(zhi)业(ye)健(jian)康,建(jian)立(li)(li)安(an)(an)全(quan)(quan)生(sheng)产(chan)和(he)职(zhi)(zhi)(zhi)(zhi)业(ye)健(jian)康一体化(hua)监(jian)管(guan)(guan)(guan)(guan)(guan)执(zhi)法(fa)体制(zhi)(zhi)。

  (十)改革重(zhong)点行(xing)(xing)业领(ling)域安(an)(an)(an)全(quan)(quan)(quan)监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)监(jian)(jian)(jian)(jian)察(cha)体制(zhi)(zhi)(zhi)。依托(tuo)国(guo)家(jia)煤矿安(an)(an)(an)全(quan)(quan)(quan)监(jian)(jian)(jian)(jian)察(cha)体制(zhi)(zhi)(zhi),加强(qiang)非煤矿山安(an)(an)(an)全(quan)(quan)(quan)生产(chan)监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)监(jian)(jian)(jian)(jian)察(cha),优化(hua)安(an)(an)(an)全(quan)(quan)(quan)监(jian)(jian)(jian)(jian)察(cha)机(ji)(ji)构(gou)布局(ju),将国(guo)家(jia)煤矿安(an)(an)(an)全(quan)(quan)(quan)监(jian)(jian)(jian)(jian)察(cha)机(ji)(ji)构(gou)负(fu)责的(de)安(an)(an)(an)全(quan)(quan)(quan)生产(chan)行(xing)(xing)政许可(ke)事项移交给地方政府承担(dan)。着重(zhong)加强(qiang)危(wei)险化(hua)学品安(an)(an)(an)全(quan)(quan)(quan)监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)体制(zhi)(zhi)(zhi)改革和力(li)量(liang)建设(she),明(ming)确和落实(shi)危(wei)险化(hua)学品建设(she)项目(mu)立(li)项、规划、设(she)计、施工及生产(chan)、储(chu)存(cun)、使用、销售、运输、废弃(qi)处置等环节的(de)法定(ding)安(an)(an)(an)全(quan)(quan)(quan)监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)责任,建立(li)有力(li)的(de)协(xie)调联动机(ji)(ji)制(zhi)(zhi)(zhi),消除监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)空白。完(wan)善海(hai)洋石(shi)油安(an)(an)(an)全(quan)(quan)(quan)生产(chan)监(jian)(jian)(jian)(jian)督管(guan)(guan)(guan)理体制(zhi)(zhi)(zhi)机(ji)(ji)制(zhi)(zhi)(zhi),实(shi)行(xing)(xing)政企分开。理顺(shun)民航、铁路、电力(li)等行(xing)(xing)业跨区(qu)域监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)体制(zhi)(zhi)(zhi),明(ming)确行(xing)(xing)业监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)、区(qu)域监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)与地方监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)职责。

  (十一)进一步完善地(di)(di)方监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)执(zhi)(zhi)法体(ti)制(zhi)。地(di)(di)方各(ge)级(ji)党委和(he)(he)政府(fu)要将安(an)(an)(an)(an)(an)全(quan)生(sheng)产(chan)监(jian)(jian)(jian)(jian)督管(guan)(guan)(guan)理部(bu)门作(zuo)为政府(fu)工(gong)作(zuo)部(bu)门和(he)(he)行(xing)(xing)政执(zhi)(zhi)法机构,加(jia)强安(an)(an)(an)(an)(an)全(quan)生(sheng)产(chan)执(zhi)(zhi)法队伍(wu)建(jian)设,强化(hua)(hua)行(xing)(xing)政执(zhi)(zhi)法职能。统筹加(jia)强安(an)(an)(an)(an)(an)全(quan)监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)力量,重点充实市、县两级(ji)安(an)(an)(an)(an)(an)全(quan)生(sheng)产(chan)监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)执(zhi)(zhi)法人员,强化(hua)(hua)乡(xiang)镇(街道)安(an)(an)(an)(an)(an)全(quan)生(sheng)产(chan)监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)力量建(jian)设。完善各(ge)类开发区(qu)(qu)、工(gong)业(ye)园(yuan)区(qu)(qu)、港区(qu)(qu)、风景区(qu)(qu)等(deng)功能区(qu)(qu)安(an)(an)(an)(an)(an)全(quan)生(sheng)产(chan)监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)体(ti)制(zhi),明确负责安(an)(an)(an)(an)(an)全(quan)生(sheng)产(chan)监(jian)(jian)(jian)(jian)督管(guan)(guan)(guan)理的机构,以(yi)及港区(qu)(qu)安(an)(an)(an)(an)(an)全(quan)生(sheng)产(chan)地(di)(di)方监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)和(he)(he)部(bu)门监(jian)(jian)(jian)(jian)管(guan)(guan)(guan)责任(ren)。

  (十二)健(jian)(jian)全(quan)应(ying)(ying)急(ji)(ji)(ji)(ji)(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)管理(li)体(ti)制。按照政(zheng)事分开原则,推进(jin)安(an)全(quan)生产应(ying)(ying)急(ji)(ji)(ji)(ji)(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)管理(li)体(ti)制改革,强化行政(zheng)管理(li)职能,提(ti)高组织协调能力(li)和现场救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)时效。健(jian)(jian)全(quan)省、市、县三级安(an)全(quan)生产应(ying)(ying)急(ji)(ji)(ji)(ji)(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)管理(li)工(gong)作机制,建设(she)(she)联动互通的应(ying)(ying)急(ji)(ji)(ji)(ji)(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)指挥平台。依托公(gong)安(an)消防、大型企业(ye)(ye)、工(gong)业(ye)(ye)园区(qu)等应(ying)(ying)急(ji)(ji)(ji)(ji)(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)力(li)量,加强矿山和危(wei)险化学品等应(ying)(ying)急(ji)(ji)(ji)(ji)(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)基(ji)地(di)和队伍建设(she)(she),实行区(qu)域化应(ying)(ying)急(ji)(ji)(ji)(ji)(ji)救(jiu)(jiu)(jiu)援(yuan)(yuan)(yuan)资源共(gong)享。

 

 

 四、大力推进依法治理

  (十三)健全(quan)(quan)(quan)法(fa)(fa)律法(fa)(fa)规(gui)(gui)(gui)体系。建(jian)立(li)健全(quan)(quan)(quan)安(an)(an)(an)全(quan)(quan)(quan)生(sheng)产(chan)法(fa)(fa)律法(fa)(fa)规(gui)(gui)(gui)立(li)改废释工(gong)作(zuo)协(xie)调(diao)机制(zhi)。加(jia)强涉及安(an)(an)(an)全(quan)(quan)(quan)生(sheng)产(chan)相关法(fa)(fa)规(gui)(gui)(gui)一致(zhi)(zhi)性(xing)(xing)审查(cha),增强安(an)(an)(an)全(quan)(quan)(quan)生(sheng)产(chan)法(fa)(fa)制(zhi)建(jian)设(she)的(de)系统(tong)性(xing)(xing)、可操(cao)作(zuo)性(xing)(xing)。制(zhi)定安(an)(an)(an)全(quan)(quan)(quan)生(sheng)产(chan)中长期(qi)立(li)法(fa)(fa)规(gui)(gui)(gui)划,加(jia)快制(zhi)定修(xiu)订安(an)(an)(an)全(quan)(quan)(quan)生(sheng)产(chan)法(fa)(fa)配(pei)套法(fa)(fa)规(gui)(gui)(gui)。加(jia)强安(an)(an)(an)全(quan)(quan)(quan)生(sheng)产(chan)和职业(ye)健康法(fa)(fa)律法(fa)(fa)规(gui)(gui)(gui)衔接融合。研(yan)究修(xiu)改刑法(fa)(fa)有(you)关条(tiao)款,将生(sheng)产(chan)经(jing)营过(guo)程中极易导致(zhi)(zhi)重大生(sheng)产(chan)安(an)(an)(an)全(quan)(quan)(quan)事故的(de)违法(fa)(fa)行为(wei)列(lie)入刑法(fa)(fa)调(diao)整范围。制(zhi)定完(wan)善高危行业(ye)领域安(an)(an)(an)全(quan)(quan)(quan)规(gui)(gui)(gui)程。设(she)区的(de)市(shi)根据立(li)法(fa)(fa)法(fa)(fa)的(de)立(li)法(fa)(fa)精神,加(jia)强安(an)(an)(an)全(quan)(quan)(quan)生(sheng)产(chan)地方性(xing)(xing)法(fa)(fa)规(gui)(gui)(gui)建(jian)设(she),解决(jue)区域性(xing)(xing)安(an)(an)(an)全(quan)(quan)(quan)生(sheng)产(chan)突出问题。

  (十四)完善标(biao)准(zhun)体(ti)(ti)系。加(jia)(jia)快安全(quan)(quan)生(sheng)(sheng)(sheng)产标(biao)准(zhun)制定修订和整合(he),建立(li)(li)以强(qiang)制性国家(jia)标(biao)准(zhun)为主(zhu)体(ti)(ti)的安全(quan)(quan)生(sheng)(sheng)(sheng)产标(biao)准(zhun)体(ti)(ti)系。鼓(gu)励依法(fa)成(cheng)立(li)(li)的社(she)会团体(ti)(ti)和企(qi)业制定更加(jia)(jia)严格(ge)规范的安全(quan)(quan)生(sheng)(sheng)(sheng)产标(biao)准(zhun),结(jie)合(he)国情积极借(jie)鉴实施(shi)国际先进标(biao)准(zhun)。国务院(yuan)安全(quan)(quan)生(sheng)(sheng)(sheng)产监督管理部门(men)负责生(sheng)(sheng)(sheng)产经营单位职(zhi)业危害预防治理国家(jia)标(biao)准(zhun)制定发布(bu)工(gong)(gong)作(zuo);统筹提出安全(quan)(quan)生(sheng)(sheng)(sheng)产强(qiang)制性国家(jia)标(biao)准(zhun)立(li)(li)项计划,有关部门(men)按照职(zhi)责分工(gong)(gong)组织起草、审查(cha)、实施(shi)和监督执行,国务院(yuan)标(biao)准(zhun)化行政主(zhu)管部门(men)负责及时立(li)(li)项、编号(hao)、对外通报、批(pi)准(zhun)并发布(bu)。

  (十五)严格(ge)安全准入制度。严格(ge)高危行(xing)业(ye)领域(yu)安全准入条件(jian)。按照强化监(jian)管(guan)(guan)与便民服务相(xiang)结合原(yuan)则,科学设置安全生产(chan)行(xing)政(zheng)许(xu)(xu)可事项和(he)办(ban)理程序,优化工作流程,简(jian)化办(ban)事环节,实施网上(shang)公开办(ban)理,接受(shou)社(she)会监(jian)督(du)。对与人(ren)民群众(zhong)生命财产(chan)安全直接相(xiang)关的行(xing)政(zheng)许(xu)(xu)可事项,依法(fa)严格(ge)管(guan)(guan)理。对取消(xiao)、下(xia)放(fang)、移交的行(xing)政(zheng)许(xu)(xu)可事项,要(yao)加强事中(zhong)事后安全监(jian)管(guan)(guan)。

(十(shi)六)规(gui)范(fan)监(jian)(jian)管(guan)执(zhi)(zhi)(zhi)(zhi)法(fa)行(xing)(xing)(xing)(xing)为。完善安(an)全(quan)生产(chan)监(jian)(jian)管(guan)执(zhi)(zhi)(zhi)(zhi)法(fa)制(zhi)(zhi)度,明确每(mei)个生产(chan)经营(ying)单位安(an)全(quan)生产(chan)监(jian)(jian)督(du)(du)和(he)(he)(he)管(guan)理主体(ti),制(zhi)(zhi)定(ding)实施执(zhi)(zhi)(zhi)(zhi)法(fa)计划,完善执(zhi)(zhi)(zhi)(zhi)法(fa)程序规(gui)定(ding),依(yi)法(fa)严(yan)格查处各类(lei)违法(fa)违规(gui)行(xing)(xing)(xing)(xing)为。建(jian)立行(xing)(xing)(xing)(xing)政执(zhi)(zhi)(zhi)(zhi)法(fa)和(he)(he)(he)刑事(shi)司(si)法(fa)衔接制(zhi)(zhi)度,负有(you)安(an)全(quan)生产(chan)监(jian)(jian)督(du)(du)管(guan)理职(zhi)责(ze)的部门(men)要加强与(yu)(yu)公(gong)(gong)安(an)、检察院、法(fa)院等协调(diao)配合,完善安(an)全(quan)生产(chan)违法(fa)线索(suo)通报、案(an)件(jian)移送与(yu)(yu)协查机制(zhi)(zhi)。对违法(fa)行(xing)(xing)(xing)(xing)为当(dang)事(shi)人(ren)拒不(bu)执(zhi)(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)安(an)全(quan)生产(chan)行(xing)(xing)(xing)(xing)政执(zhi)(zhi)(zhi)(zhi)法(fa)决定(ding)的,负有(you)安(an)全(quan)生产(chan)监(jian)(jian)督(du)(du)管(guan)理职(zhi)责(ze)的部门(men)应依(yi)法(fa)申请(qing)司(si)法(fa)机关强制(zhi)(zhi)执(zhi)(zhi)(zhi)(zhi)行(xing)(xing)(xing)(xing)。完善司(si)法(fa)机关参(can)与(yu)(yu)事(shi)故调(diao)查机制(zhi)(zhi),严(yan)肃查处违法(fa)犯(fan)罪(zui)行(xing)(xing)(xing)(xing)为。研究建(jian)立安(an)全(quan)生产(chan)民事(shi)和(he)(he)(he)行(xing)(xing)(xing)(xing)政公(gong)(gong)益诉讼制(zhi)(zhi)度。

  (十七)完善(shan)执(zhi)(zhi)法(fa)(fa)监督(du)(du)机制(zhi)(zhi)。各级人(ren)大常委(wei)会要定期检查安(an)全生(sheng)产(chan)法(fa)(fa)律法(fa)(fa)规实施情况,开展专题询问。各级政协要围绕安(an)全生(sheng)产(chan)突出问题开展民主(zhu)监督(du)(du)和(he)(he)(he)协商调(diao)研。建立执(zhi)(zhi)法(fa)(fa)行为审议制(zhi)(zhi)度和(he)(he)(he)重大行政执(zhi)(zhi)法(fa)(fa)决策机制(zhi)(zhi),评估执(zhi)(zhi)法(fa)(fa)效果(guo),防止(zhi)滥用职权(quan)。健全领导干(gan)(gan)部非法(fa)(fa)干(gan)(gan)预安(an)全生(sheng)产(chan)监管执(zhi)(zhi)法(fa)(fa)的记(ji)录、通报(bao)和(he)(he)(he)责(ze)任(ren)追究制(zhi)(zhi)度。完善(shan)安(an)全生(sheng)产(chan)执(zhi)(zhi)法(fa)(fa)纠错和(he)(he)(he)执(zhi)(zhi)法(fa)(fa)信息公开制(zhi)(zhi)度,加强社会监督(du)(du)和(he)(he)(he)舆论监督(du)(du),保证执(zhi)(zhi)法(fa)(fa)严(yan)明、有错必纠。

(十九)完善事(shi)(shi)(shi)故(gu)(gu)调(diao)查(cha)(cha)(cha)(cha)处(chu)理机制(zhi)(zhi)。坚持问(wen)责(ze)与整改(gai)并重,充分发(fa)挥事(shi)(shi)(shi)故(gu)(gu)查(cha)(cha)(cha)(cha)处(chu)对(dui)加强和(he)(he)改(gai)进安全(quan)生产(chan)工作(zuo)的促进作(zuo)用。完善生产(chan)安全(quan)事(shi)(shi)(shi)故(gu)(gu)调(diao)查(cha)(cha)(cha)(cha)组(zu)组(zu)长负责(ze)制(zhi)(zhi)。健全(quan)典(dian)型事(shi)(shi)(shi)故(gu)(gu)提级调(diao)查(cha)(cha)(cha)(cha)、跨地区协同(tong)调(diao)查(cha)(cha)(cha)(cha)和(he)(he)工作(zuo)督导机制(zhi)(zhi)。建立事(shi)(shi)(shi)故(gu)(gu)调(diao)查(cha)(cha)(cha)(cha)分析技(ji)术支撑体系,所有(you)事(shi)(shi)(shi)故(gu)(gu)调(diao)查(cha)(cha)(cha)(cha)报告要(yao)设立技(ji)术和(he)(he)管(guan)理问(wen)题(ti)专(zhuan)篇,详(xiang)细分析原(yuan)因并全(quan)文发(fa)布(bu),做好解读,回(hui)应公众(zhong)关(guan)切(qie)。对(dui)事(shi)(shi)(shi)故(gu)(gu)调(diao)查(cha)(cha)(cha)(cha)发(fa)现有(you)漏洞、缺陷的有(you)关(guan)法律法规(gui)和(he)(he)标准制(zhi)(zhi)度,及(ji)时启动制(zhi)(zhi)定修(xiu)订工作(zuo)。建立事(shi)(shi)(shi)故(gu)(gu)暴(bao)露问(wen)题(ti)整改(gai)督办制(zhi)(zhi)度,事(shi)(shi)(shi)故(gu)(gu)结案后(hou)一年内,负责(ze)事(shi)(shi)(shi)故(gu)(gu)调(diao)查(cha)(cha)(cha)(cha)的地方政府和(he)(he)国务院有(you)关(guan)部门要(yao)组(zu)织开(kai)展评估(gu),及(ji)时向社会公开(kai),对(dui)履职不力、整改(gai)措(cuo)施不落实的,依法依规(gui)严肃追究(jiu)有(you)关(guan)单位(wei)和(he)(he)人员责(ze)任。

  五(wu)、建(jian)立安全预(yu)防控制体系

  (二十)加(jia)强(qiang)安(an)全(quan)(quan)(quan)(quan)风(feng)险(xian)(xian)管(guan)控(kong)(kong)。地方各(ge)级政府(fu)要建立完善安(an)全(quan)(quan)(quan)(quan)风(feng)险(xian)(xian)评估与论(lun)证(zheng)机制(zhi),科学合理确定企(qi)业选址和基(ji)础设施建设、居民生(sheng)活(huo)区(qu)(qu)空间布(bu)局。高(gao)危项(xiang)目审批(pi)必(bi)(bi)须把安(an)全(quan)(quan)(quan)(quan)生(sheng)产作为前置条(tiao)件,城乡规(gui)划(hua)布(bu)局、设计、建设、管(guan)理等各(ge)项(xiang)工作必(bi)(bi)须以安(an)全(quan)(quan)(quan)(quan)为前提,实行重(zhong)(zhong)(zhong)(zhong)大安(an)全(quan)(quan)(quan)(quan)风(feng)险(xian)(xian)“一票否决”。加(jia)强(qiang)新(xin)材(cai)料、新(xin)工艺、新(xin)业态安(an)全(quan)(quan)(quan)(quan)风(feng)险(xian)(xian)评估和管(guan)控(kong)(kong)。紧密(mi)结合供给侧(ce)结构性改革,推动高(gao)危产业转型升级。位置相(xiang)邻、行业相(xiang)近(jin)、业态相(xiang)似的(de)地区(qu)(qu)和行业要建立完善重(zhong)(zhong)(zhong)(zhong)大安(an)全(quan)(quan)(quan)(quan)风(feng)险(xian)(xian)联防(fang)联控(kong)(kong)机制(zhi)。构建国家、省(sheng)、市、县四级重(zhong)(zhong)(zhong)(zhong)大危险(xian)(xian)源信(xin)息管(guan)理体系,对重(zhong)(zhong)(zhong)(zhong)点(dian)行业、重(zhong)(zhong)(zhong)(zhong)点(dian)区(qu)(qu)域、重(zhong)(zhong)(zhong)(zhong)点(dian)企(qi)业实行风(feng)险(xian)(xian)预警控(kong)(kong)制(zhi),有效防(fang)范(fan)重(zhong)(zhong)(zhong)(zhong)特(te)大生(sheng)产安(an)全(quan)(quan)(quan)(quan)事故。

  (二(er)十一)强化(hua)(hua)企业(ye)(ye)预防(fang)措施。企业(ye)(ye)要(yao)定(ding)期开展风险(xian)评(ping)估(gu)和(he)危害辨识。针对高危工(gong)艺、设备、物品、场所和(he)岗(gang)位(wei),建(jian)(jian)立分级管(guan)(guan)控制度(du)(du)(du),制定(ding)落实(shi)安全(quan)操作规程。树立隐患(huan)就是事故的(de)观念,建(jian)(jian)立健全(quan)隐患(huan)排查(cha)治理(li)(li)制度(du)(du)(du)、重大隐患(huan)治理(li)(li)情况向负(fu)有安全(quan)生(sheng)产监(jian)督管(guan)(guan)理(li)(li)职责的(de)部门和(he)企业(ye)(ye)职代会“双(shuang)报告”制度(du)(du)(du),实(shi)行自查(cha)自改自报闭环(huan)(huan)管(guan)(guan)理(li)(li)。严格执行安全(quan)生(sheng)产和(he)职业(ye)(ye)健康“三同时”制度(du)(du)(du)。大力推进企业(ye)(ye)安全(quan)生(sheng)产标准化(hua)(hua)建(jian)(jian)设,实(shi)现(xian)安全(quan)管(guan)(guan)理(li)(li)、操作行为、设备设施和(he)作业(ye)(ye)环(huan)(huan)境的(de)标准化(hua)(hua)。开展经常性的(de)应急(ji)(ji)演练和(he)人员避险(xian)自救培(pei)训(xun),着力提升现(xian)场应急(ji)(ji)处置(zhi)能力。

(二十二)建(jian)立隐患(huan)治(zhi)(zhi)理监(jian)督(du)机制(zhi)(zhi)。制(zhi)(zhi)定生产(chan)安全事故隐患(huan)分级和排(pai)查(cha)治(zhi)(zhi)理标准。负有安全生产(chan)监(jian)督(du)管理职(zhi)责的部门要(yao)建(jian)立与企业隐患(huan)排(pai)查(cha)治(zhi)(zhi)理系(xi)统联网(wang)的信息平台,完善线上(shang)线下配(pei)套监(jian)管制(zhi)(zhi)度(du)。强(qiang)化(hua)隐患(huan)排(pai)查(cha)治(zhi)(zhi)理监(jian)督(du)执法(fa),对重大(da)隐患(huan)整改不(bu)到位(wei)的企业依(yi)法(fa)采取停(ting)产(chan)停(ting)业、停(ting)止施工、停(ting)止供电和查(cha)封扣押等强(qiang)制(zhi)(zhi)措施,按规定给(ji)予上(shang)限经(jing)济处(chu)罚,对构成(cheng)犯(fan)罪的要(yao)移(yi)交(jiao)司法(fa)机关依(yi)法(fa)追究(jiu)刑(xing)事责任。严格(ge)重大(da)隐患(huan)挂牌督(du)办制(zhi)(zhi)度(du),对整改和督(du)办不(bu)力(li)的纳入政府核查(cha)问责范围(wei),实(shi)行(xing)约(yue)谈告诫、公开曝光,情节严重的依(yi)法(fa)依(yi)规追究(jiu)相关人员责任。

  (二(er)十三(san))强(qiang)化城(cheng)市运行安(an)(an)全(quan)保障。定期排(pai)查区域内安(an)(an)全(quan)风险(xian)点、危险(xian)源(yuan),落实管控措施,构(gou)建(jian)(jian)系(xi)(xi)统性、现代化的(de)(de)城(cheng)市安(an)(an)全(quan)保障体(ti)(ti)系(xi)(xi),推进(jin)安(an)(an)全(quan)发展示范(fan)城(cheng)市建(jian)(jian)设(she)。提高(gao)基础设(she)施安(an)(an)全(quan)配置标准(zhun),重点加强(qiang)对城(cheng)市高(gao)层建(jian)(jian)筑、大型综合体(ti)(ti)、隧道(dao)桥梁(liang)、管线管廊(lang)、轨道(dao)交(jiao)(jiao)通(tong)、燃气、电力设(she)施及电梯、游乐(le)设(she)施等的(de)(de)检测维(wei)护。完善大型群众性活动安(an)(an)全(quan)管理制度,加强(qiang)人员(yuan)密集场(chang)所安(an)(an)全(quan)监(jian)管。加强(qiang)公安(an)(an)、民政、国土资源(yuan)、住房城(cheng)乡建(jian)(jian)设(she)、交(jiao)(jiao)通(tong)运输、水利、农业(ye)、安(an)(an)全(quan)监(jian)管、气象、地震等相关部门的(de)(de)协调联动,严(yan)防自然(ran)灾害引发事故。

  (二十(shi)四)加强重(zhong)点领(ling)域工(gong)程(cheng)治理。深(shen)入推(tui)进(jin)对(dui)煤矿瓦斯、水(shui)害等(deng)重(zhong)大灾害以及(ji)矿山采(cai)空(kong)区、尾矿库(ku)的工(gong)程(cheng)治理。加快实施人(ren)口密集区域的危(wei)险(xian)化(hua)(hua)学品和(he)化(hua)(hua)工(gong)企业生产、仓(cang)储(chu)场(chang)所安(an)(an)(an)全(quan)搬迁工(gong)程(cheng)。深(shen)化(hua)(hua)油气开采(cai)、输(shu)送、炼化(hua)(hua)、码头接(jie)卸等(deng)领(ling)域安(an)(an)(an)全(quan)整(zheng)治。实施高(gao)速公路、乡村公路和(he)急弯陡(dou)坡(po)、临水(shui)临崖危(wei)险(xian)路段公路安(an)(an)(an)全(quan)生命(ming)防(fang)护工(gong)程(cheng)建(jian)设。加强高(gao)速铁路、跨海大桥(qiao)、海底(di)隧道(dao)、铁路浮桥(qiao)、航运(yun)枢纽、港口等(deng)防(fang)灾监(jian)(jian)测、安(an)(an)(an)全(quan)检测及(ji)防(fang)护系统建(jian)设。完善长(zhang)途客运(yun)车辆、旅游客车、危(wei)险(xian)物(wu)品运(yun)输(shu)车辆和(he)船舶生产制造标(biao)准,提高(gao)安(an)(an)(an)全(quan)性能,强制安(an)(an)(an)装(zhuang)智能视(shi)频监(jian)(jian)控(kong)报警(jing)、防(fang)碰撞(zhuang)和(he)整(zheng)车整(zheng)船安(an)(an)(an)全(quan)运(yun)行监(jian)(jian)管技(ji)术装(zhuang)备(bei),对(dui)已运(yun)行的要加快安(an)(an)(an)全(quan)技(ji)术装(zhuang)备(bei)改造升级。

(二十(shi)五)建(jian)立完善职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)防治(zhi)体(ti)(ti)系。将职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)防治(zhi)纳入各级政府(fu)民生(sheng)(sheng)工(gong)程及安全生(sheng)(sheng)产工(gong)作(zuo)考核体(ti)(ti)系,制(zhi)(zhi)定(ding)(ding)职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)防治(zhi)中长(zhang)期规划,实(shi)(shi)施(shi)职(zhi)业(ye)(ye)(ye)(ye)健康(kang)(kang)促进计划。加快(kuai)职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)危(wei)害(hai)严重企业(ye)(ye)(ye)(ye)技(ji)术改造、转型升级和(he)(he)淘(tao)汰退出,加强高(gao)(gao)危(wei)粉尘(chen)、高(gao)(gao)毒物(wu)品等职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)危(wei)害(hai)源头治(zhi)理(li)。健全职(zhi)业(ye)(ye)(ye)(ye)健康(kang)(kang)监管(guan)支撑(cheng)保(bao)障体(ti)(ti)系,加强职(zhi)业(ye)(ye)(ye)(ye)健康(kang)(kang)技(ji)术服务(wu)机(ji)构(gou)、职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)诊断鉴定(ding)(ding)机(ji)构(gou)和(he)(he)职(zhi)业(ye)(ye)(ye)(ye)健康(kang)(kang)体(ti)(ti)检机(ji)构(gou)建(jian)设,强化职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)危(wei)害(hai)基础研究、预(yu)防控制(zhi)(zhi)、诊断鉴定(ding)(ding)、综合(he)治(zhi)疗(liao)能(neng)力。完善相关规定(ding)(ding),扩大职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)患者(zhe)救(jiu)治(zhi)范围,将职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)失能(neng)人员(yuan)纳入社会保(bao)障范围,对(dui)符合(he)条件的职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)患者(zhe)落实(shi)(shi)医疗(liao)与生(sheng)(sheng)活救(jiu)助措施(shi)。加强企业(ye)(ye)(ye)(ye)职(zhi)业(ye)(ye)(ye)(ye)健康(kang)(kang)监管(guan)执法,督(du)促落实(shi)(shi)职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)危(wei)害(hai)告知(zhi)、日常监测、定(ding)(ding)期报(bao)告、防护保(bao)障和(he)(he)职(zhi)业(ye)(ye)(ye)(ye)健康(kang)(kang)体(ti)(ti)检等制(zhi)(zhi)度措施(shi),落实(shi)(shi)职(zhi)业(ye)(ye)(ye)(ye)病(bing)(bing)(bing)(bing)防治(zhi)主体(ti)(ti)责任。

(二十八(ba))健全(quan)(quan)社(she)会化(hua)服务(wu)(wu)(wu)(wu)体(ti)系。将安全(quan)(quan)生产(chan)(chan)(chan)(chan)专(zhuan)业技术(shu)服务(wu)(wu)(wu)(wu)纳入现代服务(wu)(wu)(wu)(wu)业发展规(gui)划,培育多元化(hua)服务(wu)(wu)(wu)(wu)主体(ti)。建立政(zheng)府购买安全(quan)(quan)生产(chan)(chan)(chan)(chan)服务(wu)(wu)(wu)(wu)制度。支持(chi)发展安全(quan)(quan)生产(chan)(chan)(chan)(chan)专(zhuan)业化(hua)行(xing)业组织,强(qiang)化(hua)自治(zhi)自律。完(wan)善注册(ce)安全(quan)(quan)工程师制度。改革完(wan)善安全(quan)(quan)生产(chan)(chan)(chan)(chan)和(he)职(zhi)业健康(kang)技术(shu)服务(wu)(wu)(wu)(wu)机(ji)构(gou)(gou)资质管理(li)办法(fa)。支持(chi)相关机(ji)构(gou)(gou)开展安全(quan)(quan)生产(chan)(chan)(chan)(chan)和(he)职(zhi)业健康(kang)一体(ti)化(hua)评价(jia)等技术(shu)服务(wu)(wu)(wu)(wu),严格实施评价(jia)公开制度,进一步激活和(he)规(gui)范(fan)专(zhuan)业技术(shu)服务(wu)(wu)(wu)(wu)市场(chang)。鼓励中小微企业订单(dan)式、协作式购买运用安全(quan)(quan)生产(chan)(chan)(chan)(chan)管理(li)和(he)技术(shu)服务(wu)(wu)(wu)(wu)。建立安全(quan)(quan)生产(chan)(chan)(chan)(chan)和(he)职(zhi)业健康(kang)技术(shu)服务(wu)(wu)(wu)(wu)机(ji)构(gou)(gou)公示制度和(he)由第三方实施的信用评定制度,严肃查处租借资质、违法(fa)挂靠、弄虚作假、垄(long)断收(shou)费(fei)等各类违法(fa)违规(gui)行(xing)为(wei)。

  (二十九)发挥(hui)市场机制(zhi)(zhi)推(tui)动作用(yong)。取消安全(quan)(quan)生(sheng)(sheng)产(chan)风(feng)(feng)险抵押金制(zhi)(zhi)度,建(jian)立(li)健全(quan)(quan)安全(quan)(quan)生(sheng)(sheng)产(chan)责(ze)任(ren)保(bao)险制(zhi)(zhi)度,在矿山、危险化学品、烟花(hua)爆(bao)竹(zhu)、交通(tong)运(yun)输、建(jian)筑施工、民用(yong)爆(bao)炸物品、金属冶炼、渔业生(sheng)(sheng)产(chan)等高危行业领域(yu)强制(zhi)(zhi)实(shi)施,切实(shi)发挥(hui)保(bao)险机构参与风(feng)(feng)险评估管控和(he)事(shi)故(gu)预防功能(neng)。完善工伤保(bao)险制(zhi)(zhi)度,加快制(zhi)(zhi)定工伤预防费用(yong)的提取比(bi)例、使用(yong)和(he)管理具体(ti)办法。积极推(tui)进安全(quan)(quan)生(sheng)(sheng)产(chan)诚(cheng)信体(ti)系建(jian)设,完善企业安全(quan)(quan)生(sheng)(sheng)产(chan)不良记录“黑名单”制(zhi)(zhi)度,建(jian)立(li)失信惩戒和(he)守信激励机制(zhi)(zhi)。

  (三(san)十)健(jian)(jian)全(quan)(quan)(quan)(quan)安(an)(an)全(quan)(quan)(quan)(quan)宣传教(jiao)育体(ti)系(xi)。将安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)产(chan)(chan)监督(du)管理(li)纳入(ru)各级(ji)党(dang)政领导干部培训内容。把(ba)(ba)安(an)(an)全(quan)(quan)(quan)(quan)知(zhi)识(shi)普及纳入(ru)国(guo)(guo)民教(jiao)育,建立完善(shan)中小学安(an)(an)全(quan)(quan)(quan)(quan)教(jiao)育和高危行(xing)业(ye)职(zhi)业(ye)安(an)(an)全(quan)(quan)(quan)(quan)教(jiao)育体(ti)系(xi)。把(ba)(ba)安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)产(chan)(chan)纳入(ru)农民工(gong)技(ji)能培训内容。严格落实(shi)企业(ye)安(an)(an)全(quan)(quan)(quan)(quan)教(jiao)育培训制度,切实(shi)做到先培训、后上(shang)岗。推进(jin)安(an)(an)全(quan)(quan)(quan)(quan)文化(hua)建设,加强警示教(jiao)育,强化(hua)全(quan)(quan)(quan)(quan)民安(an)(an)全(quan)(quan)(quan)(quan)意识(shi)和法治意识(shi)。发挥工(gong)会、共(gong)青团、妇联等(deng)群团组(zu)织(zhi)作用,依(yi)法维护(hu)职(zhi)工(gong)群众的知(zhi)情权(quan)、参与权(quan)与监督(du)权(quan)。加强安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)产(chan)(chan)公益(yi)宣传和舆论监督(du)。建立安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)产(chan)(chan)“12350”专(zhuan)线与社会公共(gong)管理(li)平台统(tong)一(yi)接报、分类(lei)处置(zhi)的举报投诉机制。鼓励(li)开展安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)产(chan)(chan)志愿服务和慈善(shan)事(shi)业(ye)。加强安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)产(chan)(chan)国(guo)(guo)际交流合(he)作,学习借鉴国(guo)(guo)外安(an)(an)全(quan)(quan)(quan)(quan)生(sheng)产(chan)(chan)与职(zhi)业(ye)健(jian)(jian)康(kang)先进(jin)经(jing)验。

     各地区各部门要加(jia)强组(zu)(zu)织(zhi)领导,严(yan)格实(shi)行领导干部安全生产(chan)工作(zuo)责(ze)任制,根据(ju)本意见提(ti)出(chu)的任务(wu)和(he)要求,结合实(shi)际认真研究制定实(shi)施(shi)办(ban)法,抓紧出(chu)台推进(jin)安全生产(chan)领域改(gai)革发展的具体政策措施(shi),明确(que)责(ze)任分(fen)工和(he)时(shi)间进(jin)度要求,确(que)保各项改(gai)革举措和(he)工作(zuo)要求落实(shi)到位(wei)。贯彻落实(shi)情况要及时(shi)向党中央、国务(wu)院报(bao)告(gao),同(tong)时(shi)抄送(song)国务(wu)院安全生产(chan)委员(yuan)会办(ban)公(gong)室。中央全面深化改(gai)革领导小组(zu)(zu)办(ban)公(gong)室将适时(shi)牵头组(zu)(zu)织(zhi)开展专项监督检查。
